We had a consistent presence at the Statehouse, amplified the voice of independent dealers, and made real strides on key issues. From progress on towing reform to clarifying training requirements, and stopping problematic legislation in its tracks, it was a productive year of advocacy. 🏛️ 2025 Legislative Debrief

What You Need to Know from the 2025 Session

Here are key updates impacting Indiana’s independent auto dealers:

 

🚨 HEA 1390 – BMV Agency Bill (Towing Regulation Update)

This year’s annual BMV bill includes a critical amendment for dealers involving towing disputes.

 

🔍 What It Does:

• Establishes a civil complaint process against towing companies.

• Adds deceptive towing practices to the list of actions enforceable by the Attorney General.

• Requires towing services or storage yards to release property within 24 hours after receiving:

  • 75% of the invoice paid

  • Proof of bond for the remaining 25%

  • Copy of a complaint filed with the AG

 

📌 Dealers with an existing bond can apply it toward this process.
📅 Complaint resolution is required within 30 days.

🖊️ Awaiting Governor Braun’s signature to become law.

📘 HEA 1382 – Dealer Training Program Clarification

Amends last year’s SEA 222-2024, which introduced mandatory training for used car dealers.

 

✅ Clarifies who must take the training:

• Dealers renewing a license

• Dealers with at least one other dealership in Indiana

 

🟢 Signed into law by the Governor on April 16, 2025.

❌ HB 1599 – Direct Sales & Vehicle Registration (Did Not Pass)

This bill addressed direct vehicle sales and registration issues. It did not receive a hearing and officially died this session.

 

⚠️ However, it remains a hot topic and is expected to return next year.
